unless there is something i am missing, there is no way this car is totaled. btw i am a NYS licensed appraiser and i co manage an FCA certified shop. for that car to total, you would have to have upwards of 35k in damages.
When my '20 JLUR was totaled the trailer hitch bent under, slightly bending the frame on the passenger side. The front bumper took a little bit of damage too. Nowhere near $35k to fix it, but our insurance totaled it. The alternative was to remove everything from the frame and put it all back onto a new one. No thanks.

I doubt if it's illegal to park on "the wrong side of the street" everywhere in the country.
It probably is. It is in Arizona, and with good reason. I almost had a head-on collision on a residential street around a curve where someone who had parked on the wrong side pulled out, but hadn't gotten over to the right side yet.

when was this? right now Ins Cos are also totaling cars because salvage bids are astronomical so totaling is cheaper than fixing. i meant like it is not totaled unless someone wants it to be totaled (ins companies can total a car out for any reason if they feel they have a need) i totaled cars out in the past just bc the customer was a headache and we wanted to avoid being married to those customers. also, the 35k was in reference to the market value of a 22 rubicon right now.

Here's what the California Vehicle Code says about parallel parking:
22502.
(a)Except as otherwise provided in this chapter, a vehicle stopped or parked upon a roadway with adjacent curbs or class IV bikeways, as defined in Section 890.4 of the Streets and Highways Code, shall be stopped or parked with the right-hand wheels of the vehicle parallel to, and within 18 inches of, the right-hand curb or the right-hand edge of the class IV bikeway, except that a motorcycle shall be parked with at least one wheel or fender touching the right-hand curb or edge. If no curbs, barriers, or class IV bikeways bound a two-way roadway, right-hand parallel parking is required unless otherwise indicated.
So, at least here in California parking on the "wrong" side of the street is, indeed, illegal. I suspect most states have similar statutes.

The Jeep would have been hit even if it was facing the "right" direction. I would say that fact is irrelevant. It is illegal in Ohio to park facing the wrong way for the side of the street. But it would not have stopped the accident from happening...

The only way parking would come to be a contributing factor is if is was parked more than 12-18" from the curb, depending on jurisdiction. The direction it was facing is not a contributing factor.

It appears, at first glance, you were parked facing traffic on the left side of the road. She hit you with enough force to shove the Jeep up over the curb with its right rear tire locked (skid mark). The Jeep swung in the direction of the impact leaving its tail out to the left which caused it to end up in the tree with her behind you.

There is no Neutral anything, no parallel parking, no "I just don't know..." You were parked on the wrong side of the street, she was texting and drifted into your parked Jeep. It was her fault, but why were you parked on the wrong side of the street?
can you tell what color shoes the OP was wearing when this happened?

Professor Plum was wearing Blue Vans with tight-fitting elastic jeans and a t-shirt. Don't know what color the t-shirt was, though.

However, Plum wasn't present when the crash happened which makes me think it was Miss Scarlett driving the errant car, and she probably used a wrench.

It is illegal in Virginia:

§ 46.2-889. Location of parked vehicles.
No vehicle shall be stopped except close to and parallel to the right edge of the curb or roadway, except that a vehicle may be stopped close to and parallel to the left curb or edge of the roadway on one-way streets or may be parked at an angle where permitted by the Commonwealth Transportation Board, the Department, or local authorities with respect to highways under their jurisdiction.

Of course, we can't be sure this wasn't a one-way road from the pictures nor the OP's narrative. Who knows? Kaboom! It's really too bad this will go down on CarFax as a collision with extensive damage. Lots of lost value with that kind of tag.

It was a 16 month old 2020 with 18k miles totaled in October. Insurance gave us several thousand more for it than we paid for it new.

no, that road is a dead end, there is no thru traffic so to speak; it’s actually safer to park facing down hill (pretty steep) as you have clear line of sight of incoming traffic (again, no thru traffic). In fact, this deadend street actually accesses a public park/little league baseball field (with no parking), and even those visitors park facing in the up hill and down direction, on both sides.

interestingly the loss of control of a vehicle on that hill/street has happened at least 4 times in my memory.

everyone is absolutely grateful no one (especially the little leaguers who pull their gear out of trunks) was on the street at the time.

I wish that was the case. I lost $11,000 on my 2018 JL accident.
I'm guessing you didn't have GAP insurance? I know some people here think it's a waste but it helped us when we totaled our Liberty years ago.

Panicked while parallel parking? Seriously...?

There are way too many people out there that should not have received a driver’s license, let alone allowed to drive.

I live in a city of 90,000 souls; about 45,000 of them drive some type of Subaru. The average driving skill on local roads here is below that of a five year old.
It's true. Especially the up and coming younger generation. Too worried about texting and social media while driving. And a lot of them are scared to drive believe it or not. They really are scared. And zero driving skills. You try teach them and they don't want to learn. I would know I have 18 year old and 23 year old daughter's. I'll just say this GOD HELP THE PEOPLE ON THE ROAD.

Pretty much why I gave up riding motorcycles. It's a death trap out there.

If a vehicle is in reverse and you don't realize it because you think it's in drive, and then if you step on the gas pedal, hard acceleration occurs and your foot becomes a brick on the gas peddle. This has the ability to cause a vehicle lunge for quite a distance before your brain comprehends the situation or a large object stops you first.
