Do I have a legitimate gripe?

I purchased a set of tires from Walmart on a Black Friday sale and just had them mounted today. They are Cooper Discoverer All Terrains, which is far as I can tell are made exclusively for Walmart as they do not show up on Cooper's website. The photographs of the tires on Walmart's website clearly show the 3-Peak designation symbol, however the tires I received do not have that marking. To be fair, there is no written mention of 3-Peak certification in the details on Walmart's website, just in the product photos. All other details seem to match the ad.

To have that 3-Peak certification would be nice, but I don't think I would have passed on these tires even if I knew they didn't have that certification. I'm just curious as to the opinion of the group as to whether or not I have a legitimate complaint to wage with Walmart. And if I do, what type of remedy should I be asking for?

They cover their butt with their legal disclaimer so even though they showed a pic with the 3 peak it may not actually be 3 peak rated.

never the less they do have a 90 day return policy so you could possibly get a better tire from them.

Idk about the 3 peak certification but I've been running Cooper Discoverer All Terrains on my Xterra for about 4 years now and they have been an absolute fantastic tire.

This could go either way. Both sides have an argument.

Depending on my mood, I might inquire about a good faith credit (for an amount that seems proportionate to the circumstances), based on the provable disconnect between the advertised image and the actual product received. If Wal-Mart refuses by bunting to published disclaimer language, then they do. If they do choose to send a gift card my way, then they do and that would be enough for me.

That's pretty much where I'm at. It is certainly not a deal breaker, but I also didn't receive exactly what was advertised. I am certainly not going to lose any sleep either way, I just put this up here to get the group's opinion.

To those saying I should never buy anything from Walmart, you're certainly entitled to your opinion. For the most part, I've had very good luck with my purchases from them both large and small. Truth be told, you get the same Chinese crap no matter where you're buying it. And to those who say I shouldn't have tires installed there, I've had much better luck with my local Walmart Tire and Auto than a lot of the folks here have had with their local Jeep dealerships - hell, I've never had them screw up an oil change and that seems to be the norm for the "experts" at Jeep.

So do airlines with their flight attendants. Amazon fulfillment employees have to piss in trash cans to avoid performance disciplines. Waitstaff make $2/hr if they get stiffed on tips. I could go on, but you get the idea. In the immortal words of Denis Leary - life sucks, get a f*ckin' helmet.
