Got into a pretty sweet wreck today. My wife turned right at an intersection and about five seconds later some asshole slammed into the back of us. We were going around 40 into a construction zone. He was probably going around 60-70. To his credit he actually pulled over, and after checking to make sure my wife and child were okay I ran across to check the occupants of the other vehicle.
The guy was fine. He got out of his car with his pants unbuttoned, unzipped and his belt undone (confused me too) and instantly began to complain that he had a green light and we had cut him off. I didn't hear any brake noise before we were hit, and checking the road there were no tire marks. He also hit us dead center meaning there had been no attempt to avoid the accident. To me, this was evidence that he had not been paying attention to the road. This assumption was further validated when he couldn't find his phone to take pictures of the accident or my insurance information. I offered to help him find it and low key searched his car. The phone was under the driver seat.
The guy wanted to tow his car but I told him to wait until the police arrived. He tried to get us to admit fault and I tried to explain the last chance clause to him that presupposes right of way, but he wasn't listening.
When the police showed up they spoke to him for a few minutes and after a field sobriety test put him in cuffs. They said he was under the influence. I didn't smell any alcohol on him or in his car but so be it.
My wife's car will most likely be written off as a loss. Now comes the challenge of convincing her to put the insurance claim towards a lift kit, and hopefully some new wheels.
