So with the spare tire on the back, when you look out the rear view mirror there is a part of the window that is blocked by the spare and the third brake light. Sooooo. Why doesn’t Jeep just notch the tailgate metal up in that spot. Reshape the window around it and bam! Now you can open the rear glass without having to open the tailgate!

Yes. I know once people go to bigger tires this will end up being a problem. But it’d just be another opportunity for the aftermarket community to come up with a solution.
I’m honestly surprised in all of these decades that this hasn’t been done.

If I recall correctly, the rear glass on my wife's Liberty opened before the swing gate. I think the glass could be released by partially pulling the swing gate handle. The spare tire was located lower on the swing gate than the wranglers offering more visibility out the rear glass. The liberty's glass required a latch to keep it closed which is similar to most other fixed roof suv's. Perhaps jeep designed the wranglers rear glass to be retained by the swing gate because of the is removable roof which eliminates one set of wiring as well as the latch. I think I prefer the simpler method that the wrangler utilizes.
