OP complained about Jeep, was told that he's being a lil' bitch. Then someone started talking about butt stuff. Everyone realized Terry was going to let them down again on the alcohol. OP said he was keeping his pretty lil' bitch Jeep. We told him to shut the fuck up it's not about you anymore. Someone brought up butt stuff again, a recurring theme in this one for some reason. Then there were lots of conversations about muh freedumbs and helmets. Which took it to around 100 pages.

Even this is nuanced. Government has all kinds of business on private property. Suppose a guy commits a rape or a murder on his private ranch. How about the reckless idiot who crashes and maims somebody while doing donuts in a supermarket parking lot? Or the drunk who runs into the UPS driver on his way up the private HOA access road?

Many states resolve these situations by saying that major traffic offenses are enforceable on private property if the area/road is “open to the public”. Basically, if others like UPS have regular access, criminal traffic laws are enforceable (but minor traffic offenses, like seatbelt and helmet violations are not).

They will charge them, in TX. In the right counties.
There is always civil court. At times, it will punish them more, in the long run.

Was hit near head on (only cause I moved to deflect most of it) by a dodge ram at 50mph in my lil Hyundai. Dude blew a .09 2 hours after the wreck so he was hammered at the time of the incident. It was his 4th DUI but first time with a wreck. They let his ass off with community service, after taking 4 years to actually have his hearing.

It took everything in my soul to not burn the courthouse to the ground.

Although I suspect it’s similar, I can’t speak to California law, but in Oregon he would have been charged, then or now, IF the crash took place upon “premises open to the public” AND the intoxication level was provable.

”Open to the public” would include a long ranch driveways that many members of the public use (UPS, vendors, neighbors, etc). If the crash occurred out between the corn rows or on private roads from which the public was excluded, the state would have no jurisdiction to prosecute, and the only remedies would be civil.
