Currently running 38x13.5 Milestars on 17x9 -12 4.5" bs fuel coverts. Thinking of going to 40 x15.5 nitto trail grapplers on 20 x 12 -44 4.77" bs fuel sfj's. I have 5.13 gears with 3.6 auto. Anybody else running the 40s on 20s with 5.13s? Thinking gearing should be ok.

The 5.13's are Low enough for that size. That's a lot of weight on stock axles, and even if it's just highway use that pinion gear is pretty small on D44.

Yeah your gearing is fine but my real concern is your D44's holding up to that much rotational mass.
