General statement......it is state dependent.

This is incorrect. The Federal Mandate is for the vehicle manufacturer to install the CHMSL. Just like it's a mandate to install Air Bags.

Not required by some state laws....again state dependent. And as long as the vehicle meets the current equipment requirements of the state it's registered in, then no legal ramifications.

I was pointing out to the OP in particular, and others in general, that what the vehicle owners in one state have to go through aren't necessarily true in other states.
All that you sa

This is all a given. Common knowledge to most.. especially if you are in a State that requires Inspection.

Those that have State Inspection are gun shy so to speak and rightfully so.

Go ahead and take it off if you don't like it.
I don't like the 3rd brake light either, but I'm leaving mine on , hoping that the next dumbass that attempts to run into me sees it and stops first.
Yup, reality is there is a valid reason(s) for a 3rd Brake Light..

I also feel all States should have mandatory vehicle inspections! No, not emissions... mechanical to see if lights, brakes and such are as they should be.

Legalities aside. Most drivers these days expect that third brake light. And with every other driver’s face in their phones and giant infotainment screens, I would want that extra brakelight myself. I hated them when they first came out, but they work.

I fully agree. Regardless of day or night, I always have my parking lights on. Past vehicles, I'd also have the headlamps on, but the JL allows fog lamps to function with the parking.

At the same time, I'm not at all a fan of the flashing brake light modules used with LED's, which is too intense and blinding to those following, especially at night. They are better paired with the less impacting incandescent brake lights. Even emergency vehicles are being equipped with the ability of only engaging the forward lighting array, because of the increased potential of being side swiped or rear ended due to the "flash blinding" of rear approaching traffic.

Even with 35's on the stock carrier, I noticed that the 3rd brake light was blocked from the drivers view of lower sitting vehicles. I got some peace of mind when it was relocated to the spare. Here's a pic of me crouched down and about 20-30 feet behind the Jeep. This pic was originally taken in landscape orientation and recropped to minimize the sides.
