This case has got to be up there with the case where a burglar got locked in the garage of the house he was robbing and had to survive on dog food for a week so he sued the homeowners, in terms of stupidity.

Glad to hear that the dealer would have been responsible for compensating the Jeep owner had he been found liable, though. I’m assuming that’s what drove the settlement.

Well, manslaughter would usually require that he either intentionally killed him, but while in a strongly provoked or “heat of passion” state of mind that would cause an ordinary person to act similarly, or he unintentionally killed him in an unlawful way, meaning criminally negligent as opposed to ordinarily negligent. In this case, they’d probably have to show the kid got into the Jeep knowing that it was a stick, that the other mechanic was in harms way and that his actions could cause the Jeep to react in such a way as to risk death or serious bodily injury to that mechanic at that time. It seems common sense, but lawyers have a way of screwing up common sense issues.

But I have to say that I still think it’s crazy stupid that you can sue the owner of the vehicle for that in that state.

That whole situation with the Jeep was wild. It’s crazy how things can go from a regular day to something so tragic in no time.
