Dealership sold my 4xe without telling me

This doesn't strike me as all that different from the various people whose Bronco preorders were not honored at the price agreed upon because "our policy requires that document be countersigned by two dealership officers, and yours was only signed by your salesperson."

A deposit is a deposit. If you put money down. It's a contractial agreement. You wasted your time with that dealership and they held your money. You could have invested that money, or spent it in Tijuana, but instead they held that money because there was some sort of agreement. I would start doing research and looking up CA State Law. I would not let something like that slide especially how hard it's been to get inventory.
It depends upon the precise verbiage on the paperwork; it likely states something that it is not a deposit for a particular vehicle, but to hold your place in line to be given an opportunity to purchase the vehicle.

You're right, there isn't a binding agreement. Mainly because that would have to go both ways, the dealer would have to sell it to the customer and the customer would be forced to buy it. That's problematic.

However most dealers would be concerned about customer experience and not find the better deal they can make on a single vehicle worth leaving a customer with a bad experience. That in itself speaks volumes.
However, it could be binding if the receipt referenced the VIN/VON. Otherwise it's a deposit on a Jeep arriving in the future and no reference to any particular vehicle.

My 12 year old grand daughter has more brains than this!

I can't understand why this thread continues when the OP has been advised (good advice) of what the correct solution is. Pouting and crying won't solve it.

Get your money back and continue on. Hopefully you've learned a significant lesson.

I put down a security deposit onto a 4xe that was a dealership order on 10/12. The vehicle was in transit during that time. I called the dealership periodically to see when it will arrive. On 10/26, they told me it will arrive next week. The week came and passed, I called last Friday 10/29 about the whereabouts of the 4xe. My salesman said it was delayed and they do not know when it will arrive; which is all fine by me. But on Sunday 10/31, I saw that the dealership removed the website listing of the 4xe, and it was marked as sold. I was like, they probably did this because there were too many people contacting the dealership acquiring about the 4xe. On Tuesday 11/2, I saw on the Jeep website that the 4xe switched from being 'in transit' to 'on dealer lot'. I thought that the dealership would call on me soon saying that they received it; they never did. And then I saw that the dealer 4xe build was taken down on Jeep's website from the search inventory section completely. I waited a little bit more, but then I checked the CarFax saw records that shouldn't be there yet. So I called my salesman from the dealership today 11/4, he said he will call me back, he never did. I tried contacting the dealership's General Manager about this matter instead, but he was such an airhead about the situation and told me he will get someone else to look into this. Then two hours later, a different salesman called me and told me that the 4xe I put a security deposit down was super delayed and has no ETA. Their solution was that I should put in my own customer order of a 4xe and the new order will arrive sooner than my previous dealer order 4xe. When I asked them if they sold it yet, they are saying no.

With all of the information taken entirely down from the internet about the Jeep, the biggest reason why I believe that the dealership sold the 4xe is based on the CarFax. Without me paying for the full amount for the CarFax, I am still able to see that there is already been 3 records listed on the 4xe's VIN CarFax, and the only record I can physically see is the Pre-delivery inspection completed on 10/28 by the dealership. There should be no way that the CarFax has already have records of anything if the 4xe is still delayed in transit to the dealership; other than the window sticker.

The weirdest thing about all of this is an email that I received from the dealership today. They forwarded an email to me from Stellantis stating:

I do not know why the dealership would send me this, but I guess it is interesting to see that Stellantis keeps track of the customer's browser history.

But anyway, if anyone has a recommendation of a different dealership to order from, please let me know. I will be willing to go out of state at this point. The only good thing that is coming from all of this is that I order 2022 instead of 2021.

To the person who might have the 4xe that is in question, congratulations on your purchase!

Update 11/5: I ended up running the CarFax, it does say it was sold. I am still waiting on the dealership to call me back to order a different Jeep; I am just going to ask for my refund. I called Jeep customer service, and they will get a specialist to look into this further.
Before asking for your deposit back if you put a deposit on a vehiclein transit and signed an agreement you have an enforceable contract although it is not formalized a most contracts that dealers do you have rights that you need to follow up with. They offered a vehicle that was in transit. You provided a deposit for said vehicle. At this point you have a breach of contract that comes with rights. They need to make you whole again. Therefore contact the general manager even better yet the owner. Explain to them that you had put a deposit down for the in transit vehicle after they offered to sell it to you. That is a contract. They will need to provide A means to make you whole again. Tell them tat a lawyer will be involved if you don’t come to an agreement. This would include a deeply discounted Wrangler. The price should be well below what you were going to, pay for the in transit vehicle. If they balk have a lawyer call them. The lawyer will negotiate a deal for you that you will be happy with.
Another member had an ordered Jeep that was sold and got a sweet deal on a 2022. I would also make sure that they provide transportation if you sold your vehicle. If you are trading in your vehicle to them they must hold the value of your trade in price.

Do not deal with the salesman or the sales manager or any other sales member. They are your issue. They saw a dealer inventory vehicle and took the order and sold it.

Did the OP every call them out on it?
I'm waiting for Jeep to investigate this problem with the original dealership. But I am dealing with other dealerships right for inquiries in 2022.

The original dealership left me a voicemail yesterday asking if I have made my decision on either returning my security deposit or placing a new order.

Take your money and run from them. Let us know who they are.

Thanks for the update. I would take the money and go elsewhere. If there are no dealerships in your area willing to provide a decent price, order out of state and have it shipped. I did this and saved a few thousand.
